## 5. Limitation of Liability

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Disputes shall first be addressed through informal, good-faith negotiations. If unresolved within thirty days, the dispute shall be settled by final and binding arbitration in Toronto, Ontario, by a single arbitrator under the Simplified Arbitration Rules of the ADR Institute of Canada. You waive your right to participate in a class-action lawsuit.

Either party may bring an individual claim in the Small Claims Court of Ontario within its monetary jurisdiction. The arbitration requirement and class-action waiver do not apply to the extent prohibited under applicable consumer protection legislation, including the Ontario *Consumer Protection Act, 2002*.

We reserve the right to seek injunctive or equitable relief in a court of competent jurisdiction to protect our intellectual property rights.
